Former Montana Tech football player given probation after pleading guilty to rape

A former Montana Tech football player Derek Nygaard who admitted he raped his ex-girlfriend has been sentenced to probation.
Derek Nygaard went to his ex-girlfriends house intoxicated and unable to properly walk, when he made some advances towards her. She rejected and asked him to leave. Nygaard proceeded to cover her mouth with his hand and rape her.
A few days later another woman told police in Montana Nygaard had sexually assaulted her a month before.
According to USA Today, being found guilty of sexual intercourse without consent can carry up to a 20-year prison sentence. But in this case, Nygaard was given a deferred sentence after he pled guilty to one of the sexual assault charges in exchange for the prosecution to drop the second charge and sign off on a deferred sentence.
I am sorry but this is not right. He should have to spend some time in prison for rape. What do you think of this situation?
