Could Richie Incognito walk scotch free from any punishment? MAYBE….
Today I spoke to an agent about the Richie Incognito case, and he told me that the NFL might not be able to punish Richie Incognito based on Article 46, Section 4 titled “One Penalty”.
The Collective Bargaining Agreement states that only one penalty may be imposed on a player.
Article 46, Section 4 says that there shall be only one penalty: “The Commissioner and a Club will not both discipline a player for the same act or conduct. The Commissioner’s disciplinary action will preclude or supersede disciplinary action by any Club for the same act or conduct.”
The NFLPA intends to fight any discipline of Incognito based on Article 46, Section 4, because Incognito was in fact suspended for 8 games, 2 of which were without pay. If this happens Richie could walk Scotch Free. IF this happens it would be interesting to see how the NFL’s own collective bargaining agreement blew up in their own face.
